Agreement

By creating an account or using Attendex you agree to these terms on behalf of yourself and the organisation you represent. If you do not agree, please do not use the service.

The service

Attendex is a cloud HR, attendance and payroll service provided by Cybex Innovation on a subscription basis. Features available to you depend on your plan. We may improve or change features over time; we will not materially reduce the core features of a paid plan during its term.

Accounts

• You must provide accurate information and keep sign-in details confidential.
• You are responsible for activity under your organisation's accounts and for the users you invite.
• Tell us promptly at info@cybexinnovation.com if you suspect unauthorised access.

Your data

Your organisation owns the data it enters into Attendex. You grant us permission to host and process it only to provide and support the service, as described in our privacy policy. You are responsible for having the right to enter employee data and for informing employees as required by law.

Payroll and compliance

Attendex calculates payroll, statutory deductions and tax figures from the information and settings you provide. You remain responsible for reviewing results, filing returns and making statutory payments. We work hard to keep calculations correct but are not liable for penalties arising from incorrect inputs or settings.

Fees and payment

• Fees are as per your quote or plan, payable in advance for the chosen term, plus applicable GST.
• Additional employees beyond your plan are billed as described on the pricing page and your quote.
• Unpaid invoices past their due date may lead to suspension after notice. Refunds are covered by our refund & cancellation policy.

Acceptable use

Do not misuse the service: no attempts to break security, overload systems, reverse engineer the software, access other organisations' data, or use it for unlawful purposes.

Availability and support

We aim to keep Attendex available at all times but planned maintenance and events outside our control may cause interruptions. Support is available by email, phone and WhatsApp.

Termination

You may stop using the service at the end of your term. We may suspend or end accounts that breach these terms. After termination you can request an export of your data within 30 days, after which it may be deleted.

Liability

To the extent permitted by law, our total liability for any claim is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect or consequential losses.

Governing law

These terms are governed by the laws of India, and the courts at Bangalore, Karnataka have exclusive jurisdiction.
